Terms of Service

These Terms of Service ("Terms") are an agreement between you and Krypton Digital LLC ("Analytix66", "we", "us", or "our"), 2952 Big Spring Ranch Rd, Delta, CO 81416, USA. They cover your use of https://analytix66.com, the Analytix66 dashboard, tracking pixel, API, AI Studio, website builder, business tools, blog, and our online store (together, the "Service"). By creating an account, buying a product, or using the Service, you agree to these Terms. If you act for a company or organization, you confirm you can bind it, and "you" means that organization.

1. The Service

Analytix66 is an all-in-one platform for small businesses and agencies. Depending on your plan, it may include:

  • Web analytics: visitor and pageview statistics, real-time visitors, goals, funnels, heatmaps, session replays, and approximate visitor location (country and city) derived from IP addresses using an IP-geolocation database.
  • AI features: AI Studio (AI-generated images, video, and text), AI insights, an "ask your analytics" assistant, weekly AI recaps, and AI promos.
  • Website builder and hosted pages.
  • Business tools: forms and lead capture, a contacts (CRM) inbox, short links, link-in-bio pages, and QR codes.
  • Blog and help content.
  • Digital product store: downloadable software scripts (such as Prismora and Glimmetric), mobile app add-ons, and related licenses.

We may improve, change, or remove features. If we remove a major paid feature you rely on, we will try to give reasonable notice.

2. Accounts

  • You must be at least 18 and able to enter a binding contract.
  • Give accurate sign-up information and keep it current.
  • Keep your password, API keys, and any AI provider keys you add secure. You are responsible for all activity under your account, including by team members you invite.
  • Tell us right away through our contact page if you suspect unauthorized access.
  • Do not create multiple free accounts to get around plan limits.

3. Acceptable use

You agree not to use the Service to:

  • Break any law, including privacy, data protection, consumer protection, anti-spam, and intellectual property laws.
  • Track websites or apps you do not own or are not authorized to track.
  • Capture sensitive data (passwords, payment card numbers, government IDs, health data) through replays, heatmaps, forms, or events.
  • Generate, host, or share illegal, infringing, sexually explicit content involving minors, hateful, harassing, deceptive, or violent content, including through AI Studio, the website builder, link-in-bio pages, or forms.
  • Create deepfakes or AI content that impersonates real people without their consent, or present AI output as human-made where the law requires disclosure.
  • Send spam or unsolicited messages, or run phishing, malware, or fraud.
  • Send fake or inflated traffic, overload, probe, scan, or disrupt our systems, or bypass usage limits.
  • Reverse engineer, copy, resell, or sublicense the Service except as these Terms or a purchased license allow.

We may remove content and suspend or limit accounts that we reasonably believe break these rules.

4. Your content and AI output

You own the content you upload or create ("Your Content"), including websites you build and, to the extent the law allows, AI output you generate. You give us a limited license to host, process, and display Your Content only to run, secure, and support the Service. AI output can be inaccurate, similar to others' output, or unsuitable; you are responsible for reviewing it and for how you use it. If you connect your own AI provider key, that provider's terms also apply and its charges are yours.

5. Your responsibilities for your visitors

When you install our tracking pixel, you decide what is collected about your visitors and why. You are the "controller" of that data and we process it for you as "processor." You are responsible for having a lawful basis (including consent where required by GDPR, UK GDPR, ePrivacy/PECR, CCPA/CPRA, or similar laws), showing a clear privacy notice and any consent banner, masking sensitive fields, and handling your visitors' privacy requests. We will reasonably help. A Data Processing Agreement is available on request through our contact page.

6. Plans, credits, and billing

  • Free plan and trials: we may offer a free plan or free trials with limits, and may change or end them. If you give a payment method for a trial, you will be charged when it ends unless you cancel first. One trial per customer.
  • Subscriptions: paid plans are billed in advance, monthly or yearly, in US dollars, and renew automatically at the then-current price until you cancel.
  • Credits: some AI features use credits. Credits have no cash value, are not transferable, and may expire as stated at purchase.
  • Payments: processed by Stripe. Card payments and, where offered, one-time payments in USDC stablecoin are supported. We never store full card numbers or crypto wallet private keys. Crypto payments are final once confirmed on the blockchain, and you are responsible for sending the correct amount on the correct network.
  • Taxes: prices exclude taxes unless stated; you pay any applicable sales tax or VAT.
  • Failed payments: we may retry, suspend paid features, or move you to the free plan until paid.
  • Changes: upgrades apply immediately and may be prorated; downgrades apply at the next billing period and may remove features or data beyond the new plan's limits. We will give at least 30 days' notice of a price increase.

7. Cancellation and refunds

You can cancel any time from your billing page or by contacting us. Your plan stays active until the end of the paid period and then does not renew. Subscription payments and used credits are non-refundable, and we do not give refunds for partial periods, except where required by law or at our discretion. Contact us within 30 days if you believe you were charged by mistake.

Digital products (scripts and add-ons): because downloads are delivered instantly, sales are final once the download or license key is provided, unless the product is materially not as described and we cannot fix it within a reasonable time, in which case we will refund you. Where local law gives you a right to withdraw from a purchase, nothing here limits it; by downloading immediately you agree that the withdrawal right ends on delivery where the law allows.

8. Software licenses (store purchases)

Each script or add-on is licensed, not sold. Unless the product page says otherwise, a regular license lets you install it on one domain for yourself or one client. You may modify it for that use, but you may not resell, redistribute, or share the source code or license keys, or offer it as a competing product. Updates and support are provided for the period stated on the product page. Server requirements, hosting, and any third-party API costs (for example AI providers) are your responsibility.

9. Data retention and deletion

We keep analytics, replays, and heatmaps for your plan's retention period, then delete them. You can export or delete data from the dashboard. After account closure we delete your data within 30 days, except what we must keep by law; backups clear within about 90 days. See our Privacy Policy.

10. Our intellectual property

The Service, software, pixel, designs, logos, and documentation belong to us and our licensors. While you follow these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service. Feedback you send may be used freely.

11. Third-party services

The Service may work with third-party services you choose (payment processors, AI providers, social logins, integrations). Their terms apply and we are not responsible for them. Location lookups use an IP-geolocation database licensed under Creative Commons Attribution 4.0 (attribution: IP Geolocation by DB-IP).

12. Suspension and termination

You may close your account any time. We may suspend or terminate accounts for serious or repeated breaches, non-payment, security or legal risk, or where required by law, with notice where reasonable. If we end the Service for everyone or close your account without cause, we will refund prepaid fees for the unused period. Sections that should survive (payment owed, IP, disclaimers, liability, indemnity, governing law) survive.

13. Disclaimers

The Service, AI output, and store products are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Analytics may be incomplete because of ad blockers, browser settings, and network issues.

14. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill. Our total liability for all claims is limited to the greater of the amounts you paid us in the 12 months before the claim or US $100. These limits do not apply to fraud, gross negligence, willful misconduct, or consumer rights that cannot be waived.

15. Indemnity

You will defend and compensate us for third-party claims, losses, and reasonable legal fees arising from Your Content, your websites, your use of AI output, your failure to obtain visitor consent, or your breach of these Terms or the law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. Disputes will be handled in the state and federal courts in Delta County, Colorado, unless your local law gives you the right to sue where you live. Please contact us first so we can try to resolve it informally.

17. Changes

We may update these Terms. For material changes we will notify you by email or in the dashboard at least 30 days before they take effect, unless the law requires sooner. Continuing to use the Service after that means you accept the new Terms; if you do not agree, cancel your account.

18. General

These Terms, our Privacy Policy, and any signed agreement are the whole agreement about the Service. If part is unenforceable, the rest remains. Not enforcing a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them in a merger, acquisition, or asset sale. Neither party is responsible for delays beyond its reasonable control.
