Terms of Service

Last updated: November 1, 2026

These Terms of Service ("Terms") are an agreement between you and Krypton Digital LLC ("Analytix66", "we", "us", or "our"), located at 2952 Big Spring Ranch Rd, Delta, CO 81416, USA. They cover your use of the Analytix66 website at https://analytix66.com, our tracking script, dashboard, API, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a company or other organization, you confirm that you have authority to bind it, and "you" means that organization.

1. The Service

Analytix66 provides privacy-friendly website analytics. Features may include visitor statistics, session replays, heatmaps, goals and conversions, team access, an API, and custom domains. The features you get depend on your plan. We may improve, change, or remove features over time. If we remove a major paid feature you rely on, we will try to give you reasonable notice.

2. Accounts

  • You must be at least 18 years old and able to enter a binding contract to use the Service.
  • You must give accurate information when you sign up and keep it up to date.
  • You are responsible for keeping your password and API keys secure and for all activity under your account, including activity by team members you invite.
  • Tell us right away through https://analytix66.com/contact if you think your account has been accessed without permission.
  • One person or organization may not create multiple free accounts to get around plan limits.

3. Acceptable use

You agree not to use the Service to:

  • Break any law or regulation, including privacy, data protection, consumer protection, and electronic communications laws.
  • Track websites or apps that you do not own or are not authorized to track.
  • Collect sensitive information such as passwords, payment card numbers, government ID numbers, health information, or similar data through session replays, heatmaps, or custom events.
  • Try to identify individual visitors where the law does not allow it, or combine Analytix66 data with other data in a way that breaks the law or your own privacy promises.
  • Track websites aimed at children under 13 (or under 16 where local law requires) without the consent the law requires.
  • Send fake, automated, or inflated traffic to the Service, or overload, probe, scan, or disrupt our systems.
  • Reverse engineer, copy, resell, or sublicense the Service, except where we have agreed in writing or the law allows it.
  • Use the Service for illegal, harmful, fraudulent, or abusive content or activity.

We may suspend or limit an account that we reasonably believe breaks these rules.

4. Your responsibilities for your visitors

When you install our tracking script on your website, you decide what data is collected about your visitors and why. That makes you the "controller" of that data, and we process it for you as your "processor." You are responsible for:

  • Having a lawful basis for collecting and using your visitors' data, including getting consent where required by law (for example under GDPR, the UK GDPR, the ePrivacy Directive, PECR, or CCPA/CPRA).
  • Showing a clear privacy notice on your website that explains your use of Analytix66.
  • Setting up a consent banner or opt-out where needed, especially for session replays and heatmaps.
  • Configuring the Service so it does not capture sensitive information, for example by masking form fields and private page content.
  • Responding to your visitors' privacy requests. We will help where we reasonably can.

Our marketing describes features designed to support GDPR, CCPA, and PECR compliance. Those features help, but using Analytix66 does not by itself make your website compliant. Our Privacy Policy explains how we handle data, and a Data Processing Agreement is available on request through https://analytix66.com/contact.

5. Plans, trials, and billing

Free plan

We may offer a free plan with limited features, websites, pageviews, or data retention. We may change or end the free plan at any time.

Free trials

Some paid plans come with a 7-day free trial. If you give a payment method when you start a trial, your subscription will start and you will be charged automatically when the trial ends, unless you cancel before then. If you do not give a payment method, your account may move to the free plan or be limited when the trial ends. Free trials are limited to one per customer.

Subscriptions and payment

  • Paid plans are billed in advance, monthly or annually, in US dollars.
  • Payments are handled by our third-party payment processor, Stripe. We do not store your full card number.
  • Prices do not include taxes unless we say so. You are responsible for any sales tax, VAT, or similar taxes that apply.
  • If a payment fails, we may retry the charge, and we may suspend paid features or move your account to the free plan until payment is made.

Automatic renewal

Your subscription renews automatically at the end of each billing period (monthly or annually) at the current price for your plan, and your payment method will be charged, until you cancel.

Upgrades, downgrades, and usage limits

If you upgrade, the change takes effect right away and we may charge a prorated amount. If you downgrade, the change usually takes effect at the start of your next billing period, and you may lose features or data that are not part of the lower plan, including data older than the new plan's retention period. If you go over your plan's usage limits, we may ask you to upgrade, or pause data collection until the next period.

Price changes

We may change our prices. We will tell you at least 30 days before a price increase affects your subscription. The new price applies from your next renewal after that notice. If you do not agree, you can cancel before the renewal.

Cancellation

You can cancel at any time from your account settings or by contacting us. When you cancel, your subscription stays active until the end of the current billing period and will not renew. After that, your account moves to the free plan (if available) or is closed.

Refunds

Payments are non-refundable, and we do not give refunds or credits for partial billing periods, unused time, or downgrades, except where required by law or where we decide otherwise at our discretion. If you believe you were charged by mistake, contact us within 30 days of the charge and we will review it. If you live somewhere that gives you a legal right to withdraw from or cancel a purchase, nothing in these Terms limits that right.

6. Your data

You own the data you and your websites send to the Service ("Customer Data"). You give us permission to host, process, and display Customer Data only as needed to provide, secure, and support the Service and as described in our Privacy Policy. We may create aggregated, de-identified statistics about use of the Service that do not identify you or your visitors, and we may use those to run and improve the Service.

We keep Customer Data for the retention period of your plan. You can export or delete your data through the dashboard or by contacting us. After your account is closed, we delete Customer Data within a reasonable time, except where we must keep it by law. Backups may take longer to clear.

7. Our intellectual property

The Service, including our software, tracking script, design, logos, and documentation, belongs to us and our licensors. While you follow these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service for your own business. If you send us feedback or ideas, we may use them freely without owing you anything.

8. Third-party services

The Service may link to or work with third-party services, such as payment processors or integrations you choose to connect. Those services have their own terms, and we are not responsible for them.

9. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your account if you seriously or repeatedly break these Terms, do not pay, create a security or legal risk, or if the law requires it. Where reasonable, we will give you notice and a chance to fix the problem first. If we end the Service for everyone or close your account without cause, we will refund any prepaid fees for the unused part of your billing period. Sections that by their nature should survive termination (including payment owed, intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

10. Disclaimers

We work hard to keep the Service accurate and available, but it is provided "as is" and "as available." To the extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that analytics data will be complete or exact. Ad blockers, browser settings, consent choices, and network issues can affect what is recorded.

11. Limitation of liability

To the extent the law allows:

  • Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, even if told they might happen.
  • Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US $100.

These limits do not apply where the law does not allow them, such as for fraud, gross negligence, or willful misconduct, and they do not limit rights you have as a consumer that cannot be waived.

12. Indemnity

You agree to defend and compensate us for claims, losses, and costs (including reasonable legal fees) brought by third parties that arise from your Customer Data, your websites, your failure to get required visitor consent, or your breach of these Terms or the law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state and federal courts located in Delta County, Colorado, unless the law where you live gives you the right to bring a claim in your local courts. Before starting a formal dispute, please contact us so we can try to resolve it informally.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the dashboard at least 30 days before they take effect, unless the change is required by law sooner. The "Last updated" date at the top shows when the Terms last changed. If you keep using the Service after the changes take effect, you accept the new Terms. If you do not agree, you can cancel your account.

15. General

  • These Terms, our Privacy Policy, and any Data Processing Agreement or order form we sign with you are the full agreement between us about the Service.
  • If any part of these Terms cannot be enforced, the rest stays in effect.
  • If we do not enforce a right right away, we do not give it up.
  • You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of assets.
  • Neither party is responsible for delays caused by events beyond its reasonable control.
